Cosmopolitan - BACHELOR OF THE YEAR 2018 – Nominations

Conditions of Entry

1. Information on how to nominate and awards form part of these Conditions of Entry. Participation in this promotion is deemed acceptance of these Conditions of Entry.

2. Nominations are open to Male residents of Australia aged 18 years and over, who either: have a current Tinder and Facebook account, who are nominated by COSMOPOLITAN editorial representative or who have entered the nomination period via COSMOPOLITAN Media Bachelor of the Year competition.

3. Entrants must be available to participate in a photo-shoot and interview with COSMOPOLITAN between 26 September to 5 October in Sydney, on the exact date and location nominated by the Promoters.

4. Employees and their immediate families of the Promoters and associated sponsors are not eligible to enter.

5. All entrants must enter this competition for recreational purposes only.

6. There are three stages of this competition. The nomination stage, judging to determine the Top 30 finalists and the voting stage to determine the overall winner.

The nomination stage: The nomination period commences on 7th August 2017 (AEST) and closes on 23rd August 2017 at 9:00am (AEST). There are three (3) ways of being nominated: via Tinder, nominated by COSMOPOLITAN editorial representative or via COSMOPOLITAN Media Bachelor of the Year competition.

Entrants who have been successfully nominated via the method of Tinder will be notified by Tinder on 15 September 2017 via email to the email address given to Tinder at the time of signing up to their Tinder account.

Entrants who have been successfully nominated via the method of COSMOPOLITAN editorial staff will be notified by a COSMOPOLITAN representative on w/c 18 September 2017 by email using the contact details given at the time of nomination.

Entrants who have been successfully nominated via the method of COSMOPOLITAN Media Bachelor of the Year competition will be notified by Bauer Media (a Promoter) on 18 September via email using the contact details given at the time of nomination.

Judging to determine Top 30 Finalists: Judging will be conducted, to determine the top thirty (30) finalists from all nominations received, to move forward to the Voting Period of the competition. Finalists will be notified by w/c 18 September 2017 via email and telephone using the contact details given in the nomination.

Voting Period: Voting will begin on 7 November 2017 and voting will close on 5 January 2018 at 17:00pm (AEDST).

7. The Promoters’ decision in relation to all issues related to nominations, judging, voting or any other aspect of this promotion is final and binding on all who participate in relation to the promotion and no correspondence will be entered into.

Nominations via Tinder:

8. One entry per person will be permitted. Only one nomination from a single Tinder profile can be made.

9. By entering via the Tinder app, you consent to your picture, name and email address to be sent to Bauer Media (a Promoter) for the purposes of judging and notifying you in the event, that you are a finalist in the competition.

10. Entry via Tinder is also subject to the services and terms of use of Tinder (found at https://www.gotinder.com/terms).

11. To enter, individuals must nominate themselves via adding the following hashtag: #TinderForCosmoBachelorOfTheYear to their Tinder profile page by 23rd August 2017 at 9:00am (AEST). In addition, other Tinder users will be able to nominate an eligible person by taking a screenshot of a profile that they think should be considered and emailing it to CosmoBach@gotinder.com by 23rd August 2017 at 9:00am (AEST).

12. After the closing date of the competition, Bauer Media (a Promoter) will contact all entrants via email with a questionnaire the entrant must complete to form part of their nomination entry. Entrants must follow the instructions within the email to submit their completed questionnaire by 8pm AEST on 30th August, 2017. Any entrants who choose not to submit their questionnaire will not be included in any subsequent judging to determine the Top 30 finalists.

For the removal of doubt, all entries received via the Tinder method of entry will be submitted to COSMOPOLITAN for judging and considered with all other nominations received in determining the Top 30 finalists.

Nominations via Cosmopolitan Editorial:

13. This nomination method will be conducted by COSMOPOLITAN editorial representatives in their discretion, based on eligible individuals they locate and wish to include. Eligibility will be judged by age, personality and talent. The COSMOPOLITAN editorial representatives will contact individuals they wish to nominate, and seek their consent, and answers to any questions selected by COSMOPOLITAN editorial representatives, before their nomination is finalised.

Nominations via Cosmopolitan Media Bachelor competition:

14. This nomination process will be conducted as per media bachelor terms and conditions available at http://www.cosmopolitan.com.au/bachelor/cosmopolitan-bachelor-of-the-year-awards-2018-nominations-23505.

Entry/Nomination Conditions

15. The Promoters are neither responsible nor liable for late, lost or misdirected entries, or entries not received by the Promoters for any reason whatsoever. 16. Each entrant warrants to the Promoters that the entry submitted is an original artistic work of the entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the entrant in relation to the entry was provided by a third party, the entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the Promoters against all claims and costs by third parties arising from a breach of the warranty set out in this condition.

17. The Promoters are entitled to use any of the entries (including all copy, information, recordings and images) submitted in any manner and for any purpose at their absolute discretion for an indefinite period, including using the entries for future book publications, promotional, marketing and publicity purposes, in any media, without any further reference or payment or other compensation to the entrant. The Promoters or Tinder are entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.

18. Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoters for any breach of these Terms and Conditions.

19. The Promoters reserve the right to verify the validity of entries at any time during or after the promotion, and reserves the right to disqualify any entrant who tampers with the entry process or who submits an Entry that is not in accordance with these Terms and Conditions. Failure by the Promoters to enforce any of their rights at any stage does not constitute a waiver of those rights. Errors and omissions may be accepted by the Promoters in their sole discretion.

20. Incomplete or indecipherable entries will be deemed invalid.

21. Entrants must disclose to the Promoters any issues that may generate negative publicity and impact on the success of this promotion and/or COSMOPOLITAN magazine. The Promoters can disqualify an entrant if such issues arise and for failure to disclose any issues that may generate negative publicity and impact on the success of the COSMOPOLITAN Bachelor of the Year 2018 Competition and/or COSMOPOLITAN magazine.

22. The Promoters reserve the right to disqualify an entrant if, in their complete discretion the Promoters deem that nominee’s continued involvement in the COSMOPOLITAN Bachelor of the Year 2018 promotion will (in any way) negatively impact on the success of the promotion and negatively influence the general purpose of the promotion. For the removal of doubt, the Promoters have the right to remove and/or disqualify a participant at any stage of the promotion. No correspondence will be entered into.

23. Each entrant agrees to inform the Promoters, before acceptance of any finalist/winner status related to this promotion, of any unspent criminal convictions of any kind subsisting at the date of entry and will notify the Promoters immediately if there are any criminal charges brought against them after the date they are nominated up to and including the date of the start of the announcement of the winner.

24. Except with the prior written consent of the Promoters, no entrant must supply commentary related to the promotion or COSMOPOLITAN of any nature to any company or person engaged in the television, pay television or radio broadcasting, printed or electronic publishing, online media, telecommunications or advertising industries (or any company, person or entity which supplies services or programs to any such companies, persons or entities) from the date entry.

25. Judging to determine Top 30:

The judging will be conducted at 54 Park Street, Sydney. Entries will be judged by a panel of judges appointed by the Promoters. The judges will determine the top thirty (30) finalists from all valid entries received from COSMOPOLITAN Bachelor of the Year 2018 nominations and COSMOPOLITAN Media Bachelor of the Year competition to go through to the voting period to determine the overall winner of COSMOPOLITAN Bachelor of the Year 2018.

26. This is a game of skill; chance plays no part in determining the finalists or the winner. Each entry will be individually judged based on the literary and creative merit of the answers to the questions provided and suitability of the nominated individual to the promotion. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into. In respect to nominations received via Tinder, the Promoter will also consider who the top 300 entrants who received the highest number of total ‘right swipes’ were (the way a female marks a male as a potential match in Tinder) on their Tinder profile during the nomination period (7th August 2017 and closes on 23rd August 2017 at 9:00am (AEDST)), however, this will not be the determining factor in selecting the finalists. The thirty (30) entries deemed to be the best by the judges will be selected as finalists.

27. At the time of finalist notification, the finalists will be given a date that they will need to be available to participate in a photo-shoot, be filmed and be interviewed for the feature appearing in COSMOPOLITAN magazine/ website for the purposes of voting. Interview, video and photo-shoot dates and times will be determined by the Promoters in their complete discretion, and are currently scheduled to take place between 26th September and 5th October in Sydney. Travel including but not limited to domestic flights, transfers, accommodation, meals, beverages and spending money will not be included and must be borne by the finalist. All costs associated to attending the photo-shoot will be the responsibility of each finalist.

**28. All finalists must be available to be photographed, interviewed or attend any events at the request of COSMOPOLITAN during the entire Voting Period, from the date of the Finalist announcement on or around 14 February 2018. Dates and times of any photo-shoots, interviews and events throughout this period will be advised to each finalist by COSMOPOLITAN and determined by COSMOPOLITAN in its complete discretion. COSMOPOLITAN reserves the right at any time to ask finalists to cease all promotional or other activities related to the promotion. Decision to cease such activities remains with the Promoters at all times.

29. It is a condition of accepting the finalist status that each finalist warrants to the Promoters that they understand that any arrangement entered into in relation to the redemption of this status does not create a relationship between the finalist and the Promoters of employer and employee, principal and agent, partnership or joint venture.

30. Except with the Promoters prior written consent, finalists must not supply commentary related to the promotion, their finalist status or COSMOPOLITAN of any nature to any company or person engaged in the television, pay television or radio broadcasting, printed or electronic publishing, online media, telecommunications or advertising industries (or any company, person or entity which supplies services or programs to any such companies, persons or entities) from the date entry.

31. It is a condition of accepting to be a finalist that all finalists agree to be interviewed, photographed and filmed (for voting purposes) at a time and date determined by the Promoters and the acceptance of the status by the Promoters or their agents for a story or feature on this promotion to be developed and featured in COSMOPOLITAN magazine, website or social media pages (or any other form of media it deems suitable) without further remuneration or reference to the participants. Feature may appear in COSMOPOLITAN magazine or website and for voting purposes on a date to be determined by the Promoters. The inclusion of any such feature (including but not limited to creative control of the feature) will remain with the Promoters at all times.

Voting Period:

32. The thirty (30) finalists will be uploaded to the Cosmopolitan Bachelor of the Year 2018 voting hub on www.cosmopolitan.com.au. Voting will begin on 7 November 2018 and voting will close on 5 January 2018 at 17:00pm (AEDST). To vote, individuals must visit www.cosmopolitan.com.au and follow the prompts to cast a vote. The overall winner of COSMOPOLITAN Bachelor of the Year 2018 will be determined by a combination of the highest number of votes received during the voting period and the decision of the panel of judges to determine the overall winner. For the avoidance of doubt, the number of votes received will not be a determinative factor in winner selection, but will simply be one of the factors considered by the judging panel.

33. Bauer Media, appointed Cosmopolitan Editorial representatives and any other appointed judges by the Promoter will determine the manner in which the final outcome will be decided and judged. The panel of judges will (using a criteria determined by the Promoter in its complete discretion, acting reasonably in the context of the nature of the promotion), judge who they consider to be the overall winner.

34. The Promoters reserve the right to verify the validity of votes and to disqualify any person who tampers with the voting process, enters into any exchange or bartering of votes (or votes or anything else) arrangements or who submits a vote that is not in accordance with these Conditions of Entry, and to disqualify any votes connected to such conduct.

35. To the extent permitted by law, the Promoters accept no responsibility for any votes not received by the Promoters or delays in the delivery of the votes due to any reason whatsoever. A vote will only be counted as being received once it has been received by the Promoters and not when it was sent. The Promoters accept no responsibility for late, lost or misdirected votes.

36. The Promoters reserve the right to keep all vote results confidential. Other than any vote results required to be revealed to maintain the format of the competition and meet legal requirements, no vote results will be revealed unless elected otherwise by the Promoter in its absolute discretion. Not all (or even any, if chosen by the Promoter) vote results will be made available to the public and/or finalists.

37. The Promoters reserve the right at their sole discretion to invalidate, discount or disqualify any votes (or individuals casting votes):

a. That tamper with, or attempt to tamper with, the voting service and/or process; or
b. Which corrupt or impact, or attempt to corrupt or impact, the administration security, fairness or integrity or proper conduct of the voting service (including a Cosmopolitan website voting mechanism) and/or the process; or
c. That the Promoters believe to be submitted via an automated process, including but not limited to computer modems, programs, scripts or any other means other than the vote service specified in these Terms and Conditions, will be deemed invalid and discounted; or
d. That the Promoters consider being manipulative, unrepresentative, disproportionate, obscene or offensive.

COSMOPOLITAN Bachelor of the Year 2018 winner announcement:

38. All finalists must be available to attend the COSMOPOLITAN Bachelor of the Year winner announcement event to be held in Sydney NSW, currently scheduled to take place on or around 14 February 2018, on an exact date and location determined by the Promoters.

39. To the extent permitted by law, the Promoters are neither responsible nor liable for any loss or damage suffered in the event that the COSMOPOLITAN Bachelor of the Year 2018 announcement event is postponed, cancelled, rescheduled or relocated for any reason whatsoever.

40. No travel including but not limited to domestic flights, transfers, accommodation, meals, beverages or spending money. will be included as a part of the finalist status or be given to a finalist to attend the COSMOPOLITAN Bachelor of the Year 2018 announcement event. All costs associated to attending the event will be the responsibility of each finalist.

41. Overall Winner of COSMOPOLITAN Bachelor of the Year 2018 - Prize:

The best (1) finalist as determined by the judges will be deemed the winner of the Cosmopolitan Bachelor of the Year 2018 competition and will receive:

o $5,000 awarded in the form of a cheque made in favour of the winner

No other prizes or compensation will be offered or awarded to the winner or any finalist.

42. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoters and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form). If for any reason whatsoever the winner chooses to either not sign any agreement, or requests to not be bound by the terms of the agreement, they have signed with the Promoters then the winner will forfeit the prize.

43. The Promoters have the right to terminate any agreements it may have signed with the winner, subject to the terms signed in the winner agreement.

44. The overall winner of COSMOPOLITAN Bachelor of the Year 2018 must be available to be photographed, filmed, interviewed or attend any events at the reasonable request of the Promoters for a one (1) year period from the date of the announcement event, for a story or features on this promotion to be developed and featured in COSMOPOLITAN magazine, websites and social media sites (or any other form of media the Promoters deem suitable), without any further compensation being payable to the winner. This story or feature will appear in COSMOPOLITAN magazine and/or website at a time to be determined by the Promoters. All control relating to any such story or feature will remain with the Promoters at all times. In the event of an interview, COSMOPOLITAN magazine will determined the topic and format in which they may ask the winner to contribute to the magazine and advise the winner of their assignments throughout the year. COSMOPOLITAN reserves the right at any time to ask that the winner to cease providing COSMOPOLITAN promotional and other activities related to the promotion. Decision to cease COSMOPOLITAN activities remains with the Promoters at all times. The winner will receive any reasonable travel costs to attend required promotional activities, as pre-approved and organised by the Promoter. All travel costs are subject to prior approval by the Promoter in its discretion.

45. It is a condition of accepting the prize that the winner warrants to the Promoters that they understand that any arrangement entered into in relation to the redemption of this prize does not create a relationship between the winner and the Promoters of employer and employee, principal and agent, partnership or joint venture.

46. Except with the Promoter’s prior written consent, the winner must not supply commentary related to the promotion, their win or COSMOPOLITAN of any nature to any company or person engaged in the television, pay television or radio broadcasting, printed or electronic publishing, online media, telecommunications or advertising industries (or any company, person or entity which supplies services or programs to any such companies, persons or entities) from the date entry.

General:

47. Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or transferable. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoters accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.

48. In the event that for any reason whatsoever the winner does not take the prize at the time stipulated by the Promoters, then the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.

49. In the event that a prize, or part of a prize, is unavailable, the Promoters reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification.

50. To the extent permitted by law, the Promoters are neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).

51. To the extent permitted by law, the Promoters are not responsible nor liable for any prize damaged in transit in the delivery of their prize

52. Any cost associated with accessing any promotional website or accessing the Internet is the participants’ responsibility and is dependent on the Internet service provider used.

53. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster), the Promoters reserve the right to, to the extent permitted by law, cancel, terminate, modify or suspend the promotion and disqualify and entrant.

54. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances by contacting the Promoters.

55. If an entry is selected as a finalist or a winning entry, validation of the entrant’s circumstances/ the validity of the entry will be undertaken by the Promoters. Method of validation (without limitation) will be determined by the Promoters in their complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoters request the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoters. It is a condition of accepting the prize the winner sign any such legal documentation.

56. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters, (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

57. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters, (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters’ control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize or rescheduling or cancellation of any event for reasons outside of the control of the Promoter.

58. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, the Promoters reserve the right, in their sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

Bauer Media:

59. Bauer Media collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. Bauer Media will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.bauer-media.com.au/privacy.htm. In addition to any use that may be outlined in the Bauer Media Privacy Policy, Bauer Media may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to Bauer Media and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of Bauer Media. The Promoter may disclose PI to entities outside of Australia – see Privacy Policy for details.

Tinder:

60. By entering this contest and/or the acceptance or use of any prize, each entrant agrees to Tinder’s manner of collection, use, retention, and disclosure of personal information submitted in connection with the contest, including without limitation, all names, addresses, emails, phone numbers, and birth dates obtained from or provided by entrants. Information collected is subject to Tinder’s privacy policy and any applicable law. Tinder’s privacy policy can be found at www.gotinder.com/privacy. Consult the aforementioned policy for information on how Tinder collects and uses user information.

61. The Promoters are Bauer Media Pty Ltd (ABN 18 053 273 546) of 54 – 58 Park Street, Sydney, NSW 2000, Phone: 02 9282 8000 and Tinder, Inc. of 8833 W. Sunset Blvd, 4th Floor, West Hollywood, CA 90069. For the avoidance of doubt, Bauer Media Pty Ltd is solely responsible for the administration of this contest.
