Terms and conditions for Cosmopolitan's Bachelor of the Year Awards 2019 nominations

Cosmopolitan — BACHELOR OF THE YEAR 2018 — Nominations

Conditions of Entry

1. Information on how to nominate and awards form part of these Conditions of Entry. Participation in this promotion is deemed acceptance of these Conditions of Entry.

2. Nominations are open to single Males, who are residents of Australia aged 18 years and over, who either: have a current Tinder and Facebook account, nominated by COSMOPOLITAN editorial representative or who have entered via COSMOPOLITAN Media Bachelor of the Year competition.

3. All entrants must be available to participate in a photo-shoot and interview with COSMOPOLITAN on a specified date determined by the Promoter between 26th September 2018 and 5th October 2018 in a location in Sydney (location still to be determined, potential finalists will be informed of these details of location at the time of notification of finalist placing).

4. Employees of the Promoters, employees of associated sponsors and their immediate families are not eligible to enter.

5. All entrants must enter this competition for recreational purposes only.

6. There are three stages of this competition. The nomination stage, judging to determine the Top 30 finalists and the voting stage to determine the overall winner.

The nomination stage: The nomination period commences on August 13th 2018 and closes on August 29th 2018 at 9:00am (AEDST). There are three (3) ways of being nominated into the overall COSMOPOLITAN Bachelor of the year 2016: via Tinder, nominated by COSMOPOLITAN editorial or via COSMOPOLITAN Media Bachelor of the Year.

Judging to determine Top 30 Finalists: Judging will begin on 3rd September 2018 to determine the top thirty (30) finalists to move forward to the voting period of the competition. The judging will be held at Bauer Media office, 54 Park Street, Sydney NSW 2000. Entries will be judged by a panel of judges appointed by the Promoters.

Entrants who have been deemed a finalist via the entry method of Tinder will be notified by Tinder between 5:00pm (AEST) on 17th September 2018 to 21st September 2018, via email to the email address given to Tinder at the time of signing up to their Tinder account.

Entrants who have been successfully nominated via the method of COSMOPOLITAN editorial will be notified by COSMOPOLITAN representative will be notified between 5:00pm (AEST) on 17th September 2018 to 21st September 2018 by email using the contact details given at the time of nomination.

The entrant who has been successfully nominated via the method of COSMOPOLITAN Media Bachelor of the Year will be notified by Bauer Media (Promoter) between 5:00pm (AEST) on 17th September 2018 to 21st September 2018 via email using the contact details given at the time of nomination.

Voting Period: Voting will begin on 7th November 2018 and voting will close on 4th January 2019 at 17:00pm (AEDST).

7. The Promoter's decision in relation to all issues related to this promotion is final and binding on all who participate in relation to the promotion and no correspondence will be entered into.

Nominations via Tinder:

8. One entry per person will be permitted and the entry may be submitted to one Tinder account only.

9. By entering via Tinder app, you consent to your profile picture (at the time and point of nomination), entrants full name and email address will be sent by Tinder to Bauer Media (Promoter) for the purposes of judging and notifying you in the event, that you are a finalist or winner in this competition.

10. Entry via the Tinder app is subject to the features, functionality, services, terms of use and privacy policy of the Tinder platform. Terms of use can be found at: https://www.gotinder.com/terms. Privacy Policy can be found at: https://www.gotinder.com/privacy. Please note that nominations via Tinder in no way changes or affects the normal functionality and purpose of registering with the Tinder application.

11. To enter, individuals must nominate themselves via adding the following hashtag: #TinderForCosmoBachelorOfTheYear to their Tinder profile page. All entrants who have identified by this promotional hash tag will be collected by Tinder and passed on to BAUER Media for stage 2 of the promotion.

12. After the closing date of the competition, Bauer Media (Promoter) will contact all entrants via email with a questionnaire the entrant must complete to form part of their nomination entry. Entrants must follow the instructions within the email to submit their completed questionnaire. Any entrants who choose not to submit their questionnaire will not be included in any subsequent judging to determine the Top 30 finalists.

For the removal of doubt, all entries received via the Tinder method of entry will be submitted to COSMOPOLITAN for judging to determine the Top 30 finalists. The judging will be a combination of the literary and creative merit of the answer to the questions provided, suitability to the Promotion and the top 300 entrants who received the highest number of total 'right swipes' (the way a female marks a male as a potential match on Tinder) on their Tinder profile during the nomination period (13th August 2018 and closes on 29th August 2018 at 9:00am (AEDST)).

The entrant understands that while this form of voting is being tracked by Tinder/ COSMOPOLITAN for purposes of the promotion, it has no effect on the normal feature set of Tinder application and therefore an entrants decision/action in response to the "right swipe" is governed by the standard terms of Tinder and Bauer Media is in no way responsible for any consequences of the entrants response.

Nominations via Cosmopolitan Editorial:

13. To be eligible to be nominated by COSMOPOLITAN editorial, submissions must be submitted during the nomination period and include their full name, age, occupation/talent, contact email address and answers to the questionnaire. Entrants must follow the instructions on how to submit their submission as instructed by COSMOPOLITAN editorial.

Nominations via Cosmopolitan Media Bachelor:

14. Nominations are as per COSMOPOLITAN media bachelor of the year terms and conditions which can be found at www.bauer-media.com.au/competitions

15. The Promoters are neither responsible nor liable for late, lost or misdirected entries, or entries not received by the Promoters for any reason whatsoever.

16. The Entrant warrants to the Promoters that the entry submitted is an original artistic work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the Promoters against all claims and costs by third parties arising from a breach of the warranty set out in this condition.

17. Each entrant grants to the Promoter an irrevocable, worldwide and perpetual license to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future Promoter's or their agents book publications, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The Promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of any submitted entry.

18. Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoters.

19. The Promoters reserve the right to verify the validity of entries at any time during or after the Competition Period, and reserve the right to disqualify any entrant who tampers with the entry process or who submits an Entry that is not in accordance with these Terms and Conditions. Failure by the Promoters to enforce any of its rights at any stage does not constitute a waiver of those rights.

20. Incomplete or indecipherable Entries will be deemed invalid.

21. Entrants must disclose any issues that may generate negative publicity and impact on the success of this promotion and/or COSMOPOLITAN magazine. The Promoters can disqualify an entrant for failure to disclose any issues that may generate negative publicity and impact on the success of the COSMOPOLITAN Bachelor of the Year 2019 Competition and/or COSMOPOLITAN magazine.

22. The Promoters reserve the right to disqualify an entrant if, in their complete discretion the Promoters deem that nominee's continued involvement in the COSMOPOLITAN Bachelor of the Year 2019 promotion will (in any way) negatively impact on the success of the promotion and negatively influence the general purpose of the promotion. For the removal of doubt the Promoters have the right to remove and/or disqualify a participant at any stage of the promotion. No correspondence will be entered into.

23. Each entrant agrees to inform the Promoters, before acceptance of any finalist/winner status related to this promotion of any unspent criminal convictions of any kind subsisting at the date of entry and will notify the Promoters immediately if there are any criminal charges brought against them after the date they are nominated up to and including the date of the start of the announcement of the winner.

24. Except with our prior written consent, no entrant must supply commentary related to the Promotion and/or COSMOPOLITAN magazine, of any nature to any company or person engaged in the television, pay television or radio broadcasting, printed or electronic publishing, online media, telecommunications or advertising industries (or any company, person or entity which supplies services or programs to any such companies, persons or entities) from the date entry.

Judging to determine Top 30:

25. This is a game of skill; chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the questions provided, suitability to the Promotion and as stipulated in clause 12. The judges' decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.

26. At the time of finalist notification, the finalists will be given a date that they will need to be available to participate in a photo-shoot, be filmed and be interviewed for the feature appearing in COSMOPOLITAN magazine/website/social media accounts and for the purposes of voting (or any other form of media it deems suitable) without further remuneration or reference to the participants. Any feature date will be determined by the Promoters. The inclusion of any such feature (including but not limited to creative control of the feature) will remain with the Promoters at all times. Interview, video and photo-shoot dates and times will be determined by the Promoters in its complete discretion, and are currently scheduled to take place between 26th September 2018 and 5th October 2018. Travel including but not limited to domestic flights, transfers, accommodation, meals, beverages, spending money will not be included. All costs associated to attending the photo-shoot will be the responsibility of each finalist.

27. All Finalists must be available to be photographed, interviewed or attend any events at the request of COSMOPOLITAN during the entire voting period from 7th November 2018 to (on or around) 14 February 2019. Dates and times of any photo-shoots, interviews and events throughout this period will be advised to each Finalist by COSMOPOLITAN and determined by COSMOPOLITAN in its complete discretion. COSMOPOLITAN reserves the right at any time to ask Finalists to cease providing COSMOPOLITAN services. Decision to cease COSMOPOLITAN services remains with the Promoters at all times.

28. It is a condition of accepting the finalist status each finalist warrants to the Promoters that they understand that any arrangement entered into in relation to the redemption of this status does not create a relationship between the finalist and the Promoters of employer and employee, principal and agent, partnership or joint venture.

29. Except with our prior written consent, no Finalist must supply commentary related to the Promotion and/or COSMOPOLITAN magazine, of any nature to any company or person engaged in the television, pay television or radio broadcasting, printed or electronic publishing, online media, telecommunications or advertising industries (or any company, person or entity which supplies services or programs to any such companies, persons or entities) from the date entry.

30. As a condition of accepting the prize, each Finalist must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form). If for any reason whatsoever the Finalist chooses to ether not signs the any agreement, or requests to not be bound by the terms of the agreement, they have signed with the Promoters then the Finalist will forfeit the prize.

Voting Period:

31. The thirty (30) finalists will be uploaded to the Cosmopolitan Bachelor of the Year 2019 voting hub on www.cosmopolitan.com.au. Voting will begin on 7 November 2018 and voting will close on 4th January 2019 at 17:00pm (AEDST). The overall winner of COSMOPOLITAN Bachelor of the Year 2019 will be determined by a combination of the highest number of votes received by any finalist during the voting period, the interview, video and photo shoot material (taken at the finalist stage of competition) and a set criteria (as set by the promoters for judging purposes) for the panel of judges to determine the overall winner.

32. Bauer Media, appointed Cosmopolitan Editorial representatives and any other appointed judges by the Promoter will determine the manner in which the final outcome will be decided and judged. The panel of judges who will (using a criteria determined by the Promoter in its complete discretion), judge who they consider to be the overall winner.

33. The Promoters reserve the right to verify the validity of votes and to disqualify any entrant who tampers with the voting process or who submits a vote that is not in accordance with these Conditions of Entry.

34. The Promoters accept no responsibility for any votes not received by the Promoters or delays in the delivery of the votes due to any reason whatsoever. A vote will only be counted as being received once it has been received by the Promoters and not when it was sent. The Promoters accept no responsibility for late, lost or misdirected votes.

35. The Promoters reserve the right to keep all Vote Results confidential. Other than the Vote Results required to (without limitations) be revealed to maintain the format of the competition, meet legal requirements etc. Not all vote Results will be made available to the public and/or Finalists.

36. The Promoters reserve the right at its sole discretion to invalidate, discount or disqualify any votes (or individuals casting votes):

a. That tamper with, or attempt to tamper with, the Voting Service and/or process; or
b. Which corrupt or impact, or attempt to corrupt or impact, the administration security, fairness or integrity or proper conduct of the Voting Service (including a Cosmopolitan website voting mechanism) and/or the process; or
c. That the Promoters believe to be submitted via an automated process, including but not limited to computer modems, programs, scripts or any other means other than the Vote Service specified in these Terms and Conditions, will be deemed invalid and discounted; or
d. That the Promoters considers being manipulative, unrepresentative, disproportionate, obscene or offensive.

COSMOPOLITAN Bachelor of the Year 2019 winner:

37. All finalists must be available to attend the COSMOPOLITAN Bachelor of the Year winner announcement event to be held in Sydney NSW currently scheduled to take place on or around 14 February 2019. Event date is subject to availability and may change. Dates will be notified to all finalists via email.

38. The Promoters are neither responsible nor liable for any loss or damage suffered in the event that the COSMOPOLITAN Bachelor of the Year 2019 announcement event is postponed, cancelled, rescheduled or relocated for any reason whatsoever.

39. Travel including but not limited to domestic flights, transfers, accommodation, meals, beverages, spending money will be included. All costs associated to attending the event will be the responsibility of each finalist.

40. Overall Winner of COSMOPOLITAN Bachelor of the Year 2019 - Prize:**

The best (1) finalist as determined by the judges will be deemed the winner of the COSMOPOLITAN Bachelor of the Year 2019 competition and will receive:

o $5,000 - awarded in the form of a cheque made in favour of the winner

41. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form). If for any reason whatsoever the winner chooses to ether not signs the any agreement, or requests to not be bound by the terms of the agreement, they have signed with the Promoters then the winner will forfeit the prize.

42. The Promoters have the right to terminate any agreement it may have signed with the winner, subject to the terms signed in the Winner Agreement.

43. The Overall winner of COSMOPOLITAN Bachelor of the Year 2019 must be available to be photographed, filmed, interviewed or attend any events at the request of COSMOPOLITAN for a one (1) year period from the date of the announcement event to be the Promoters or their agents for a story or feature on this promotion to be developed and featured in COSMOPOLITAN magazine, website and social media sites (or any other form of media it deems suitable). This story or feature will appear in COSMOPOLITAN magazine and/or website at a time to be determined by the Promoters. All control relating to any such story or feature will remain with the Promoters at all times. In the event of an interview, COSMOPOLITAN magazine will determined the topic and format in which they may ask the winner to contribute to the magazine and advised the winner of their assignments throughout the year. COSMOPOLITAN reserves the right at any time to ask that the winner to cease providing COSMOPOLITAN services. Decision to cease COSMOPOLITAN services remains with the Promoters at all times

44. It is a condition of accepting the prize that the winner warrants to the Promoters that they understand that any arrangement entered into in relation to the redemption of this prize does not create a relationship between the winner and the Promoters of employer and employee, principal and agent, partnership or joint venture.

45. Except with our prior written consent, the winner must supply commentary related to the Promotion and/or COSMOPOLITAN magazine, of any nature to any company or person engaged in the television, pay television or radio broadcasting, printed or electronic publishing, online media, telecommunications or advertising industries (or any company, person or entity which supplies services or programs to any such companies, persons or entities) from the date entry.

General:

46. Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoters accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.

47. In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoters, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.

48. In the event that a prize, or part of a prize, is unavailable, the Promoters reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification.

49. The Promoters is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).

50. The Promoters is not responsible nor liable for any prize damaged in transit in the delivery of their prize

51. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.

52. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster)the Promoters reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.

53. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.

54. If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoters. Method of validation (without limitation) will be determined by the Promoters in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoters requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoters. It is a condition of accepting the prize the winner sign any such legal documentation.

55. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

56. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, neither the Promoters nor Tinder, Inc. (including their respective officers, employees and agents) (collectively, the "Released Parties") is responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Released Parties' control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Released Parties) due to any reason beyond the reasonable control of the Released Parties; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

57. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, the Promoters reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

Bauer Media:

58. The Promoter (Bauer Media) collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.bauer-media.com.au/privacy.htm. In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoters may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoters and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoter (Bauer Media).
