Donald Trump is being sued by the porn star he was accused of cheating on Melania with

Adult-film actress Stormy Daniels is taking on legality of the nondisclosure agreement.

Porn star Stormy Daniels has been in the headlines in recent months because of her alleged affair with US President Donald Trump and now her lawyer says she's on a mission to "set the record straight."

The adult film actress, whose real name is Stephanie Clifford, reportedly filed a lawsuit in Los Angeles County Superior Court on Tuesday, reports CBS News. Apparently the suit disputes the nondisclosure agreement she had signed days before the 2016 presidential election, which stopped her from being able to talk about the rumoured affair, is "null and void and of no consequence" because the NDA was signed by Donald Trump's lawyer, Micheal Cohen, but not by Trump himself.

Clifford's lawyer, Michael Avenatti, said on morning news shows Wednesday (March. 7) that his client "doesn't have a desire to profit from her story", but said "she wants the public to know the truth."

Avenatti also told said on NBC there was "no question" Trump knew about the NDA agreement, but the counsel he did not offer any evidence to support that claim.

While Trump denies the affair his lawyer has admitted he paid the actress $130,000 out of his own pocket as part of the agreement. About the payment Cohen said that "neither the Trump Organization nor the Trump campaign was a party to the transaction with Ms. Clifford, and neither reimbursed me for the payment, either directly or indirectly."

Stephanie claims she and Trump began an "intimate relationship" in 2006 (the year after Trump married his current wife, Melania) and that it continued "well into the year 2007," according to the lawsuit; the alleged timeline suggests that an affair would have been taking place just months after Donald's wife Melania gave birth to their son, Barron.

On Wednesday (Mar. 7) The White House rebuked any claims made in the lawsuit when press secretary, Sarah Huckabee Sanders was posed with questions from reporters.

"The president has addressed these directly and made very well clear that none of these allegations are true," Sanders said during a White House briefing. "It has already been won in arbitration."

Clifford's lawyers argue that Trump never signed the NDA so he could deny knowing about it.

"Mr. Trump purposely did not sign the agreement so he could later, if need be, publicly disavow knowledge," Daniels' lawyers said.

Clifford's lawsuit also alleges that Trump and Cohen "aggressively sought to silence Ms. Clifford as part of an effort to avoid her telling the truth, thus helping to ensure he won the Presidential Election."
